CLIENT BRIEF
RTP Surveyors were instructed following the termination of a lease at a high street retail unit to prepare a Terminal Schedule of Dilapidations. The instruction required assessment of the tenant’s compliance with their repairing and maintenance obligations under the lease and the formal documentation of any breaches identified at lease end.

KEY CONSIDERATIONS
A detailed review of the lease documentation was undertaken, including the schedule of condition appended to the lease, in order to establish the extent of the tenant’s repairing liabilities. This required careful interpretation of lease terms, particularly where obligations were modified or limited by the agreed condition of the property at lease commencement.

A full inspection of the premises was carried out to assess the condition of the property at lease end and identify disrepair items falling within the tenant’s obligations.

Consideration was given to issues of causation, scope of liability, and the potential impact of supersession in respect of any identified defects. In addition, the landlord’s position in relation to loss and mitigation was taken into account, particularly given that the property was actively being marketed for disposal or reletting.

OUTCOME
A fully costed Terminal Schedule of Dilapidations was prepared for service on the tenant, identifying breaches of lease covenants and the associated remedial works required to remedy disrepair.

The report provided a structured basis for negotiations between the parties and supported the landlord in assessing their position in relation to end-of-lease liabilities.
