CLIENT BRIEF
RTP Surveyors were instructed to prepare a Designated Advisor’s Report under Section 119 of the Charities Act 2011 in relation to the disposal of a former Methodist chapel in Penzance. The instruction required an assessment of the property’s condition, value, and the most appropriate method of disposal to achieve best consideration.

KEY CONSIDERATIONS
The property had previously been subject to a positive pre-application enquiry for conversion to residential use; however, physical defects were identified, including evidence of timber decay and water ingress associated with an adjoining property.

An initial marketing process resulted in an offer being received, but the proposed transaction subsequently failed due to the identified defects and associated risks.

RTP Surveyors reviewed alternative disposal strategies in accordance with statutory requirements under the Charities Act 2011, with consideration given to market conditions, asset condition, and achievable value.

Given the circumstances, disposal by auction was identified as the most appropriate route to secure an open market sale while maintaining transparency and compliance with statutory obligations.

OUTCOME
A Designated Advisor’s Report was issued setting out the recommended disposal strategy and supporting valuation advice.

Following implementation of the recommended approach, the property was successfully sold at auction, achieving the anticipated value set out within the report.

The process provided the Trustees with a compliant and structured route to disposal, ensuring that best value considerations were appropriately evidenced and achieved.
